Obsidian faces class-action alleging California wage-law violations
Obsidian Entertainment is being sued in a class-action alleging systematic violations of California wage and hour laws; the studio denies “each and every allegation.”
Obsidian Entertainment, developer of Fallout: New Vegas, Avowed and The Outer Worlds, is the target of a class-action complaint alleging a “systematic pattern of wage and hour violations” under the California Labor Code and IWC Wage Orders. GamesRadar first reported the case, which has been ongoing since October last year and drew renewed attention after a Reddit user highlighted an amended complaint filed in January. Plaintiff Victoria Turner, whose name matches a QA lead on The Outer Worlds 2, seeks to certify a class of current and former non-exempt California employees from October 9, 2021 through the date of class certification, and those who left on or after October 9, 2022. The complaint alleges Obsidian failed to pay all wages, including minimum and overtime pay and wages due on separation, did not timely pay wages during employment, and failed to provide lawful meal periods, compensation in lieu, and rest breaks. The amended complaint contains additional allegations; Obsidian has denied “each and every allegation.”
